INITIAL APPLICATIONS application for this 2 year visa, called Further Leave to Remain:

1) Spouses and civil partners of UK citizens and of UK permanent residents can apply for this visa if they are already in the UK on any other visas (fiancee, worker, student visas etc). Applicants have to provide a marriage/civil partnership certificate and also have to meet requirements for funds and accommodation. Children under 18 y.o. can be included with the main applicant (parent), we don't charge extra in our fees.

2) Unmarried and same-sex partners have to meet the same requirements as above plus provide evidence that the parties have been living together in a relationship akin to marriage or civil partnership for at least 2 years.

EXTENSIONS for those who currently have a 2 year visa of this type.

Normally, after 2 years on the initial visa a spouse or partner is eligible to apply for permanent residency, called Indefinite Leave to Remain or Settlement. However, some people cannot meet all conditions and therefore have to apply for another extension, normally issued for another 2 years.

Common reasons why people apply for an extension instead of a permanent visa:

- Most common reason is when an initial 2 year visa was issued abroad (called Entry Clearance) but a spouse/partner delayed entry to the UK for more than 28 days. When this visa is about to expire a spouse/partner would not have completed a 2 year residency in the UK - a mandatory requirement for a permanent visa (ILR).

- Spouse/partner hasn't passed a Life in the UK test.

- Spouse/partner has been absent from the UK for more than 90 days in a year.

Requirements for an extension would are almost the same as for an initial visa. Spouses/civil partners would have to add documents showing their marriage/partnership was subsisting for the past 2 years. For info on permanent residency please click here.

ALL APPLICANTS applying for any 2 year visa as a spouse/partner have to provide biometric data (fingerprints and facial image). We can advise on the rules, check the documents and forms. Then you can either book an appointment for same-day decision at Home Office, attend it in person and provide the required biometrics at the same time. Or we can submit applications for postal service and the Home Office would then send a letter inviting you (and dependants) to provide biometrics at one of 17 post-offices nationwide (without appointments, post-office charges £8); or at one of 7 biometric enrolment centres (by appointment).
